People who would not usually be qualified to become permanent residents of Canada may be able to apply on humanitarian and compassionate grounds under this category of immigration. People with extraordinary circumstances are protected on humanitarian and compassionate grounds. These applications are evaluated on an individual basis. The following factors are taken into account:
- How well-established the individual is in Canada
- Family links to Canada in general
- Any children involved's best interests, and
- What will happen if you fail to get permanent residency in Canada?
You are eligible for permanent residence from within Canada under thisCategory if you meet the following criteria:
- Are you a foreign national residing in Canada?
- Require an exemption from one or more of the Immigration and Refugee Protection Act's (IRPA) standards;
- Feel that humanitarian and compassionate factors warrant providing the necessary exemption(s); and
- Are unable to apply for permanent residence from within Canada in any of the following categories:
- Spouse or legal partner;
- Caregiver on-site;
- Caregivers: those who look after children or others who have special medical requirements.
- Protected Individuals and Convention Refugees; and
- Holder of a Temporary Resident Permit.
This category is for those who do not fit the ordinary requirements of the Immigration Act and Regulations, but whose circumstances need humanitarian and compassionate considerations.
